第六单元 申诉与索赔

在国际贸易合同的执行过程中，如有一方违约，受损失的一方（一般是买方）有权根据合同的有关条款向违约方提出申诉或索赔。
申诉或索赔应通过双方友好协商解决，如果协商不能解决，争议项下案件可以提交被告所在国仲裁机构仲裁，仲裁裁决是最终的，对双方都具有约束力。仲裁费由败诉方承担。
通过本章学习，学生将学会书写申诉、索赔及理赔等信函。

这是近2个星期来我司第二次向贵司提出同样的问题。我们觉得很难理解：为什么不在事前做些防范以免类似的事情发生。
虽然不是所有的货物都有污渍，但在短期内两次发生这种事情，即显示包装质量有问题或装箱粗暴。希望贵司在处理以后的定货时，能注意这一点。
该T恤衫虽能使用，但按目前情况，我们无法以正常价格出售，故我司希望你们能在发票价格基础上给予10%的优待。如果贵司不能同意的话，我们只能将该批货物退回。

贵司5月11日传真收悉。来函要求我司赔偿标题货物的损失。
对贵司遭受的损失我们深表遗憾。“阳光号”于本月7日从上海开往泗水途中不断遭遇恶劣气候及暴雨。根据航行日志记载，为防止雨水入舱，舱内的通风设备不得不较长时间关闭。由于采取了这一措施，舱内产生水汽，导致大蒜发芽。这是我司无法控制的情况，根据提单规定，我司对这项损失不能负责。我们建议你们向船运公司或保险公司去联系索赔。
希望这次不愉快的事不会对我们将来的业务往来有什么负面影响。
